Safe Condition
Condition for Safe Operation
Part 107 requires the remote pilot in command to ensure the small UAS is in a condition for safe operation before every flight. This is a legal duty — not a suggestion. If the aircraft is not airworthy, it cannot legally fly.
- "Condition for safe operation" means the aircraft is free of defects that could affect safe flight.
- This includes physical condition, firmware status, battery health, and configuration.
- The FAA can ask: 'How did you determine the aircraft was safe to fly?' Have an answer.
- If you discover a defect during inspection, document it and ground the aircraft until resolved.
Pilot in command
The remote PIC bears ultimate responsibility. You cannot delegate the determination that the aircraft is safe — you make the call.
